Privacy Notice

Document FK-WEB-04. Effective 5 October 2026.

This notice explains what FeeKing Konsult Corporation collects through this website and when you buy from us or become a client, why, and your rights under the BVI Data Protection Act, 2021.

Website enquiries: what we collect

Only what you enter in the enquiry form: your name, organization and email (required), and your phone number, organization size, number of locations, preferred start period, the service you're interested in and your main concern. If you email us or book a call, we receive what you send or enter there.

Website enquiries: why we collect it

Only to reply to your enquiry: to understand which service may fit, prepare a quote for your organization's size, and contact you. We don't use it for anything else, and we don't sell, rent or share it for anyone's marketing.

Legal basis: your consent, given when you submit the form, and our legitimate interest in responding to a request you started. Your electronic submission is a valid record under the BVI Electronic Transactions Act, 2021.

Package purchases

When you buy an HR Documentation Package we keep your name, business name, email address and the invoice and payment record. We also keep what you enter in the Company Information Form: company details, working arrangements, and the roles responsible for HR matters. We use this to prepare and deliver your package, record your license and keep our accounts. The form doesn't ask for employee files, and we ask you not to send any. Payment is by bank transfer, so we don't collect card details.

Client documents and engagement records

If you engage us for an assessment or an Implement project, you send us business documents so we can do the work. These can include contracts, policies, permit records and personnel records, and some contain personal data about your employees.

  • What we ask for. Only what the agreed service needs. Where personal details aren't needed, we ask you to remove them before sending.
  • Why we use it. Only to deliver the service set out in your engagement terms. Our legal basis is our contract with you and our legitimate interest in delivering it properly.
  • Your role. You remain responsible for your employees' data and confirm you're entitled to share it with us for this purpose. We act on your instructions.
  • How it reaches us. Through the submission route named in your engagement terms. Please don't send client documents through the enquiry form or by ordinary email.
  • Who can see it. Only the reviewer named in your engagement terms.
  • Where it's kept. In our Google Workspace business account, in a folder restricted to your engagement. Google may process data outside the Virgin Islands.
  • How long. For the period stated in your engagement terms, then deleted. We keep the engagement agreement, invoices and our report for our business and legal records.

If you're an employee whose details were shared with us by your employer, you can use the rights below by contacting your employer or emailing us.

Interest in future services

If you register interest in a service that isn't open yet, we keep your details only to tell you when it opens. Ask at any time and we'll remove you.

How long we keep enquiries

If your enquiry becomes an engagement, it's kept with that engagement's records under the retention terms in your engagement terms. Otherwise, we keep it only as long as needed to reply, and delete it whenever you ask.

Your rights

Under the Data Protection Act, 2021 you can ask what data we hold about you, ask us to correct or delete it (unless we must keep it for a legal or contractual reason), object to how it's used, and complain to the applicable BVI data protection authority. If this notice changes, we'll post the new version here with a new effective date. We won't reduce your rights without clear notice.

Package Purchase Terms

Applies to HR Documentation Packages: the Essentials Bundle, the Essentials + Workplace Pack, the Probation Pack and the Probation + Performance Pack. Effective 11 October 2026.

1. Ordering

You order a package using the order form on our website or by email. We reply with the full document list for each package you order, a quote, an invoice and bank transfer instructions. Paying the invoice confirms you have seen that list. Prices are in US dollars. Your order is confirmed when your payment clears. Each package can be bought on its own, and more than one package can be ordered on one invoice.

2. Payment

Payment is in full, by bank transfer, before we begin. We don't take card payments and there are no recurring charges.

3. Your company information

After payment clears, we send you a link to our online Company Information Form. It asks for your company details and a few yes/no questions that decide which sections of the Virgin Islands Labour Code, 2010 apply to your business. Don't include employee files or personal details about individual employees. We prepare your package from your answers. You are responsible for them being complete and accurate. We don't check them against your records, and we don't examine your existing practices, employee records, payroll, work permits or compliance position.

4. What we prepare

We prepare your documents from the Virgin Islands Labour Code, 2010, inserting your company's details and including the sections that apply on the basis of your answers. Each clause cites the section it is drawn from. The wording follows the Code and isn't rewritten for each business. We check the package for completeness, consistency and insertion errors. If your package includes the employment agreement (the Essentials Bundle and the Essentials + Workplace Pack), you receive one agreement prepared for your company; individual agreements for each employee aren't included. If you order two packages that contain the same document, you receive it once.

5. Delivery

We email your package within 5 business days of receiving your completed Company Information Form. If the form is incomplete, the 5 business days start when it is complete.

6. Your responsibilities

You complete the employee-specific details, issue the documents, obtain signatures and acknowledgements, follow the procedures, and update the documents when your circumstances change.

7. Cancellation and refunds

You can cancel for a full refund at any time before we start preparing your package. Once we've started, we don't refund. If we make an error in preparing your package, tell us within 14 days of delivery and we'll correct it free of charge.

8. Support and changes

Your purchase includes one clarification email within 14 days of delivery, about how to complete the documents supplied. New or changed company information after delivery is quoted separately.

9. What your purchase doesn't include

Advice on your situation, later updates, training, meetings, putting the documents into practice, or any review or verification of your completed documents, employee records or compliance position. The documents set out provisions of the Labour Code; they are not legal advice.

10. Agreement

By paying the invoice you agree to these terms and the Template Usage License, which licenses the documents to one business.

Template Usage License

Document FK-LIC-001. Applies to the Essentials Bundle, the Essentials + Workplace Pack, the Probation Pack and the Probation + Performance Pack. Effective 11 October 2026.

1. Grant of license

On purchase, FeeKing Konsult Corporation grants the Purchaser a non-exclusive, non-transferable license to use, adapt and implement the documents in the purchased package ("the Templates") for the Purchaser's own internal business purposes, subject to these terms.

2. Licensed entity

This license covers one registered legal entity (one company registration number or equivalent). Each additional related or affiliated entity needs its own license or a Group License naming that entity at purchase. Entities can't be added to a Group License later without upgrading.

3. Group pricing

The first entity is always full price. If the license covers 2–3 entities, each additional entity is 15% off; if it covers 4–6 entities, each additional entity is 25% off. Prices are rounded to the nearest dollar. For 7 or more, contact us for a quote. All covered entities must be named when ordering.

4. Permitted use

  • Adapting the Templates with your own details, branding and policy choices
  • Using the adapted Templates for your own workforce documentation and HR administration
  • Printing or storing copies for use by your own personnel

5. Prohibited use

  • Reselling, sublicensing or redistributing the Templates, original or adapted, to any third party
  • Sharing the Templates with other businesses, including related entities not covered by your license
  • Using the Templates as the basis for a competing product or service
  • Removing license or document control information from the Templates

6. No advisory relationship

We prepare your package by inserting the company information you supply into our standard documents. We have not examined your records, practices or circumstances, and buying a package does not create an advisory relationship.

7. No warranty of legal sufficiency

The Templates are grounded in the Virgin Islands Labour Code, 2010 and related legislation as at the date prepared. We don't warrant that they will be sufficient for your circumstances as adapted, or that they reflect later changes in law. Independent legal review is recommended for sensitive or high-risk matters.

8. What the purchase includes

A package purchase is the customised documents only. It does not include training, meetings, review of your records, practices or completed documents, or any further service or obligation.

9. Term

This license is perpetual for the Templates as purchased. Future updates aren't included unless purchased separately or stated at sale.

Acknowledgement

By purchasing the Templates, the Purchaser agrees to these terms.
